1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to New Zealand and Australian residents aged 18 years or over who are able to take the prizes within 12 months of winning the prizes. Employees (and their immediate families) of the Promoters and agencies associated with this promotion are ineligible to enter.
3. Entrants must be on the Dive Fish Snow Travel database at the time of the draw and to claim the prize.
4. The Promoters reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Only one entry permitted per person.
6. Entries close on 30/04/2013. The draw will take place at Dive Fish Snow Travel, 39A Apollo Drive, Auckland, NZ during the first week of November, 2012. The Promoters reserve the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
7. The Promoter’s decision is final and no correspondence will be entered into.
8. The Promoters will publish each entrants lucky number, within their November ReelTimes and the winning number will be announced on the Dive Fish Snow Travel webpage on the Dive Fish Snow Travel website, along with details on how to claim the prize.
9. The first winner to contact the noted Dive Fish Snow Travel appointed contact and claim the prize will win the $1150 Bradley 4 Rack Digital Smoker and the $2000 Dive Fish Snow Travel Voucher.
10. Prize is not transferrable to another person and is not exchangeable for cash. The $2000 Travel Voucher can only be used for one total fishing package for up to 2 people including airfares and land content for a destination as per Dive Fish Snow Travels Fishing portfolio.
11.  Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
12. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the Promoters reserve the right, at their discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
13. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
14. Except for any liability that cannot be excluded by law, the Promoters and prize suppliers (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking a prize.
15. As a condition of accepting a prize, the winner (and any companion/s) must sign any legal documentation as and in the form required by the Promoters / Prize Supplier /organisers in their absolute discretion including but not limited to a legal release and indemnity form.
16. The Promoters collect personal information in order to conduct the Promotion and may, for this purpose, disclose such information to co sponsors, and as required, to by regulatory authorities. Entry is conditional on providing this information. If an entrant opts in at the time of entry, the Promoters may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoters. All entries become the property of the Promoters.
